Qb Sam Keller Vs Ea Sports Ncaa Football

6 posts in this topic

For those why haven't heard, last month former Nebraska quarterback Sam Keller is suing EA Sports and the NCAA, saying the video-game maker wrongly uses the names and likenesses of athletes and the NCAA sanctions the practice. His lawsuit is based on the fact EA uses the likeness of the players to sell 650,000 units a year without compensating the faces selling the product.

So far opinion has been divided, with some fans blaming Keller for the latest updated, generic and grossly inaccurate rosters for NCAA 10, and others pointing the finger at EA for making money selling the likenesses of players with no compensation or permission.

What is your take on the situation? personally I hate EA for their monopolising business practices so I hope it hits them hard.

where it is not fair the one word that comes to mind is money. ea knows that selling the likeness of a product is going to create a demand of the product. its not like they just started making ncaa its been around for years and im pretty sure he wasnt the only person complaining about not getting paid but have the likeness of him created in the game. it all comes down to he wants money and thats illegal in college sports thus the reason ea is not allowed to put players on their bankroll until after they come out and are probally already paid. i personally think that the law suit should be dropped due to the fact that they are not using his name on the game.

This is a generalization, but I think most players don't care about their likenesses being in the game. If anything, a lot of them love it because it's the first taste of fame for them (and sometimes, their only taste.)

My logic is, unless the NCAA wants to compensate these players for marketing them in other areas (such as those image promos during commercial breaks), EA Sports shouldn't be obligated to compensate the players neither. Though EA Sports profits from the video game, the NCAA profits even greater from their collegiate brand.

As for whether the players should be compensated for the game, period? Well, if only a select number of players care, then it's a non-issue in my book. Is it fair to the players that do want to be compensated? Not necessarily. But these players are already being compensated in a sense through their academic and athletic scholarships (which walk-ons can earn), as well as the opportunities their fame will afford them. This suit focuses on monetary compensation, but ignores the other perks that most NCAA football players enjoy.

That, and Sam Keller's just mad that he was never drafted and failed to make the Oakland Raiders.

i was just about to come back and mention the fact that he wanted until he wasnt doing anything to try and sue EA. he would have had a much better case had he done it when he came out of college. if all else fails atleast he knows that people know his name as the guy who sucked and couldnt hack it but has a hott girl friend LoL.

I guess I get where he is going with it. Since the players names aren't in the game and its just the position and their number he don't have a case. It's not like EA put the names in of the college players, I wish the court would just drop it, if EA puts the names of the players in the games than it becomes an issue. Until than.... I'll be going to ESPN and other sites to print off the roster and editing the rosters in NCAA 2010 so the names are in.
