Not sure how much actual physical testimony happens in a case like this... might be none at all. The ball boy doesn't really have much relevance in this case, since its not a question of guilt or innocence at this point.

They still may subpoena them.  As they were the ones who received the text messages.  I don't believe that the Patriots are going to be able to determine what the court does.  Whether they hear testimony or not, I believe that they may, where there is an accusation of misconduct by the defendant (NFL) in this case.  If evidence indicates a specific reason, they also may not, as the plaintiff was uncooperative and non-compliant with an independent investigation.
