Browns fan urinates on Art Modell's Grave

Not sure urinating privately on a grave site is an infraction at all.  It's not Indecent Exposure because no one was present to be offended. 

 

Its not Disorderly Conduct because once again there was no one to feel threatened or be intimidated. 

 

It's not Criminal Mischief because no property was destroyed or damaged.

 

Once a person dies in many respects their legal interests cease, all that remains are property disposition issues.  The State takes possession of the body to conduct autopsies, many times against the wishes of families.  Things change with death.

 

Was it offensive? Maybe. But what is was more than anything was a rabid fan still upset with the man that moved his team making a statement.

 

The State may work hard to make it's own statement.  In over-reaching they may gerrymander some kind of charge, the validity of which will be immediately contestable.

 

He's an empathetic figure of sorts. He's "Too Brown". One has to respect that.

That being said, it is an infraction to "urinate in public".  Yes you can be arrested for it.

This is just wrong.  Art Modell was a respected hero of the Baltimore community after a 12 year drought of football.  One of the first cities to start NFL football and this is how we are treated... The land of Johny Unitas has places all across the city to represent sports and sports history and Art Modell is a big part of this history.

Art for moving the team and the Ravens for being good and winning superbowls. Cleveland has never won one.

The person who did that on Art's grave is big coward, yes he put it on YouTube, but he was too chicken to let people post comments below it.

Had Cleveland given Modell a new stadium, he may have stayed...  They battled that for quite some time, and it was no secret that Modell was considering a move...he tried bargaining, and eventually it happened.  It is my belief that with all that Art Modell had done for the NFL, he felt he deserved that.  He was a HUGE factor in the growth of the NFL.  Just my opinion...  but when he found out that Baltimore wanted to build the stadium down near Camden Yards, it threw up a red flag for him....  and he began negotiations with Baltimore.

Ironically, this incident could drum up enough sympathy / support for the Modell family that Art could be inducted into the HOF...

 

Just a hope. It's a shame he's not there already, but word is Cleveland media members hold it up.

Looks like Baltimore County police will in fact charge this man possibly with disorderly conduct.  Max punishment is 2 years in jail and $500 fine.

According to the Cleveland viewpoint he timed the move announcement the day before the vote on a new stadium which passed,.

 

According to John Moag of the Maryland Stadium Authority, the Bengals,  Cardinals and Buccaneers were interested in relocating here, but Modell beat them to the punch.  Baltimore was the runner up to Arizona when Bill Bidwell moved the team from St. Louis in 1986 and they used it a leverage to built University of Phoenix stadium later on

Paul S. Serbu, 61, of the first block of Meadowcrest Dr. in Franklin, Ohio, was issued a criminal summons last month ordering him to appear in court to face the misdemeanor charge, which carries a maximum sentence of two years in jail and a $500 fine. He was identified by police Tuesday.

 

61 years old lol. If he does go to jail, at least he'll like the colors!

Our second SB is really a turning point for the Ravens history because Baltimore Colts fans finally move on from the past and completely accept Baltimore Ravens, based on my best knowledge.

 

Browns fans are haters, and the best way to really piss them off is we are going to keep loving Baltimore Ravens and our team keep winning championships......

Well to be fair, if they could win 2 SBs in 11 years they  might not be so hateful.  Still I say this guy needs to forced to pee on a live electric fence.  I wouldn't condone a Ravens fan doing to Irsay either, but Model was no Irsay.

Keep in mind those fines and jail time are the MAXIMUM.  I dont see thing going beyond a small fine and a slap on the wrist.

 

Granted having his name and home town made public ( and not by mistake I am sure ) could lead to further ( and ill-advised ) justice.

Looks like they have identified the guy. Paul Serbu 61 of Franklin Ohio. This is a suburb of Dayton between Dayton and Cincinatti. Now I no this is a no smack forum but the majority of Browns fans are like this. I live in Youngstown Ohio about an hour southeast of Cleveland and believe me the ones i work with think this is the funniest thing ever. Don't believe me come stay a weekend at my house and wear your Ravens jerseys around town. Evry Sunday my wife and I go to Sams Club. when Modell passed the lady who checks your reciept at the exit say our Ravens jerseys and seemed to think it was a good idea to tell us how happy she was that Modell was dead!!! We go to Cleveland ever year for the game, about three years ago when my son was 5 we were at a game. He tturned and looked at me and said "daddy I like going to the Ravens games more in Baltimore" Me: "why buddy?" Him "because everybody keeps calling us [rude names]." Nice fans huh calling a 5 year old that when he's walking up the steps to the bathroom.

With that said though are we any differant? I seem to remeber when Irsay passed they were selling Tshirts in the parking lot with a Ravens bird peeing on Irsay's grave with the saying "rest in piss". People were in the stadium holding them up infront of Irsay's box. We are alot like these Cleveland fans. We both had an owner that couldn't get along with City Council to get a new stadium built so the owners relocated "THEIR" teams. We are both very passionate about our football and couldn't stand the owner who moved "THEIR" team.

What this guy did was very disrespectful but I wonder how many Ravens fans have done the same but just were smart enough not to put it on the internet?

I am not discounting what they have done to your son.....  That's horrible.....  I would agree with all of what you said, Ravens fan....  EXCEPT, that being said... The one part that people seem to forget is that "the franchise" was left in Cleveland...  The colors, the logos, and their history.  The NFL gave them immediate relief to re-establish their team under an expansion deal.  They were back on the field in 2 years..... It was different.

 

The Irsay's took it all.  They took the name, the logos, the colors, and the history... Johnny U and the rest are displayed in the HOF with the Indianapolis Colts.....  They even took the secretary's desk with all of her personal belongings...  as well as Vince Bagli's...  Mayflower went bankrupt in Baltimore...  All without even acknowledging it to the City of Baltimore. They would have taken the Band uniforms had they not been at the dry cleaners.....  Irsay raped the town of their team and it's history,  It was a little different.  The Browns knew their team was leaving... and despite that, OUR City was bypassed TWICE for expansion...  The only way Baltimore was going to get a team was to get one that wanted to relocate.  14 years, we worked, raised money, and begged for a football team.  I have absolutely NO SHAME in what we are...

I agree with everything you said. I also want to add to the guy you quoted, some people  may have created and sold t shirts of a Raven peeing on Irsay's grave but no fan actually went to his gravesite and actually did it. Cleveland fans are mad at Modell because he took the football team that he owned and couldn't get a new stadium for to another city that would give him what he wanted. He left everything to them and they were back on the field in a new stadium in 3 years. Modell told the city he was leaving and the NFL got them another team and stadium very fast. Irsay left over night without telling anyone. The NFL didn't let us keep the name, colors, jersey, records, etc. Modell is the reason why we have a team.

 

I won't tell Brown's fans to get over it because I won't ask Ravens fans to get over Irsay. At some point common sense and decency has to come into place. Why go to someones gravesite to desecrate it. You don't have to like everyone but at least respect their gravesite. The gravesite is for that persons family and loved ones. Who wants to go to someones gravesite to visit and have smell urine or see any desecration. I don't think there is any reason for that.

That being said, it is an infraction to "urinate in public".  Yes you can be arrested for it.

 And exposing oneself in a public place isn't like the tree falling in the woods. It IS illegal to expose oneself in public. Besides the camera apparently did see it.
