Lockout Back In Place... Temporary Stay Granted

Sad that it has to come to this but I'm not complaining. If she ends the lockout, I'm going to be happy.

I'll be happy if she lifts it, and even happier if it means a short period for Free Agency before next Thursday's Draft. Though unfortunately, we all know if the lockout is lifted the League will appeal the decision so it won't be over by a long shot.

I have to agree with you, friend - should the lockout be lifted, there is a chance, possibly strong, that the League would appeal the lifting of the lockout.

However, i am certainly hoping that there can be some mediation and - with any luck at all - an end to this labor dispute.

Hopefully, should she decide to lift the lockout, the appeal doesn't take effect before the draft so that teams can trade players for picks.

Another thing which I heard is that something which would make the players more interested in negotiating would be for the owners to pay them a weekly/monthly salary all year round as opposed to pay checks. Therefore they would be missing out on money right now, and would be more willing to give a little in order for a deal to get done.

If the Lockout is lifted and the NFL doesn't appeal the decision and allows some kind of Trading and Signing, I guarantee that the league will be like ok fine but we are under the 2010 Free Agency Rules including the Final 8 so we can forget about Aso.

Well, it's sounding like there's going to be a stay of any injunction pending the NFL's appeal... so there won't be any movement player-wise regardless of the judge's decision :(

That makes no sense to me. Doesn't the Judge have the final say no matter what?

Yes, but this is a lower court and the NFL will want to appeal her ruling to the court of appeals to tie everything up and keep the lockout in place as long as possible... so while her ruling would be binding if the NFL doesn't appeal, once they appeal, it's no longer up to her but the appellate court to either affirm (grant the injunction) or reverse (deny the injunction) her decision.

This is all assuming she grants the injunction and lifts the lockout.

So a higher court can keep her decision and lockout stays lifted or higher court does what it wants? I am not quite grasping this high low court thing. Sorry if this is annoying, but I just am not understanding.

Basically once Judge Nelson rules, one side or the other will most likely appeal to the court of appeals where her ruling will be reviewed. IF she grants the injunction in favor of the players, essentially ending the lockout, she will also likely "stay" the ruling (i.e., delay its enforcement) until the court of appeals rules on the matters brought up on appeal by the NFL.

Oh ok. Well I hope she lifts lockout I mean thats what us fans want. I hope nelson is a football fan and rules in favor of players so she can too also watch NFL.

I hope she is a fan, but the law doesn't need to be involved in this. if she likes football then make her decision based off of that. Can't be that hard.

Me too, but we all know whoever loses will appeal her decision so I wouldn't get too excited over the possibility of having some sort of Free Agency Period before Thursday's Draft.

It would interesting if we did have a small Free Agency period just days before the Draft and seeing how that would change the Draft Board for teams who sign players.

Edit: Does anyone know the time she is suppose to make her ruling, I thought she would have made it early morning.

Stupid in my opinion if she does that. She and every lawyer and judge involved don't realize that this will effect the rest of their careers as a Judge, Lawyer and Mediator. If they can show they can get the NFL to agree on a CBA it helps show they can handle other cases, but if not guess what maybe they won't be able to handle other cases if they can't handle something this big. That's something she and everyone else should be worried about.

I agree let's hope for Football at the very least. It would be nice to have Free Agency for a couple days before the Draft but right now I just want to be sure I can look forward to Week 1 against the Steelers and not disappointed because Football didn't start on time and we would have to miss Week 1.

Well I love this ruling as well but like I said and even ESPN mentioned it. Most likely the Owners will appeal this so there will be the moment of happiness for it being lifted and then it will go back to sadness once the Owners appeal.

The Legal Expert on ESPN just said the Appeal process would take a week or less so if the Appeals Court sides with Judge Nelson and doesn't grant the appeal we may have Free Agency as soon as next week!

Rotoworld is even saying that with this ruling teams may possibly begin contacting Free Agents but I highly doubt that teams would do anything unless they knew for sure they could.

Could you imagine the fight days before the draft to grab Aso, QB Needy teams trying to trade for Veterans.... in words of Christ Mortenson, it would be chaos if Free Agency were to happen just days before the draft.
