Class Action Email Vs Ea

Apparently there is an email going out to people about the whole case against EA for being the only company who can make a NFL Game. I just got the email and was seeing if anyone else got it. Here's what it said:

Membership as a class member in the Electronic Arts Litigation is the result of a lawsuit filed in the U.S. District Court, Northern District of California, Oakland Division (Case No. 08-cv-02820 CW).

What Is This Class Action About?
The class action lawsuit alleges violations of California's antitrust and consumer protection laws in connection with the sale of certain football video games. Plaintiffs, purchasers of Electronic Arts' football video games, claim that Defendant Electronic Arts entered into a series of exclusive licenses with the National Football League (NFL), National Football League Players' Association (NFLPA), National Collegiate Athletics Association (NCAA), and Arena Football League (AFL), which Plaintiffs claim foreclosed competition in an alleged football video game market. Plaintiffs allege that this series of exclusive licenses caused customers who purchased certain football video games to be overcharged.
Defendant Electronic Arts has denied any liability and all allegations of misconduct. The Court has not decided whether the Defendants did anything wrong, and this Notice is not an expression of any opinion by the Court about the merits of any of the claims or defenses asserted by any party to this litigation.

Who Are Class Members?
The Class includes all persons who, during the period January 1, 2005 to the present, purchased the Madden NFL, NCAA Football, or Arena Football League brand video games published by Electronic Arts with a release date of January 1, 2005 to the present. Excluded from the class are purchasers of software for mobile devices, persons purchasing directly from Electronic Arts, persons purchasing used copies of the relevant football video games, and Electronic Arts' employees, officers, directors, legal representatives, and wholly or partly owned subsidiaries or affiliated companies.

What Should I Do? (Getting Further Information)
If you believe that you may be a class member (see above "Who Are Class Members"), you should get more detailed information about the class action and its potential effect on you and your rights. Did anyone else get this email? I just copied and pasted what I saw in the email I got so there really so the source was just my inbox lol.

It's an odd case, but I do hope they win. Madden has been such a water-downed product due to the exclusive license. The Super Star mode is garbage and the Franchise mode is stale and boring. To me it's just a $60 roster update that I get suckered into buying every year.

You need competition. Look at NBA 2k11. It wasn't just a roster update for a sports game, it's one of the best games I've played in years. EA's NHL 11 is a great game since they have to compete with 2k11. MLB The Show is so much better than MLB 2k series. With a monopoly the developers just get lazy because they know consumers have no other choice. But you bring in other develops who can have that same license that was once exclusive, you give people options and have to actually make the game great instead of mediocre.

Since the NFL lost their anti-trust suit with American Needle, I hope the same goes for EA. I want better presentation like NFL 2k5 had, make the super star mode even half as good as My Player in NBA 2k11, and combine NFL Head Coach into the franchise mode.

I don't see anything coming of this, if it's true. The NFL and NFLPA signed an exclusive agreement with EA, so unless there is someway that EA violated terms of said contract, I see nothing that can be done. Actually, I believe that EA and the NFL just extended the contract for another year. All these petitions and "class action lawsuits" are pipe-dream by fans. Because you know what EA and the courts will say? If you don't like it, don't buy it. In this circumstance, money speaks louder than anything else. While sales have been down, they still sell alot of copies, and until EA starts to make a substantial less amount of money, no change will be seen. Although if you ask me, Madden has slowly improved since 08 and 09.

I got one of those concerning Sports Illustrated and it's giving out of Madden 2010 with a subscription. That one I tossed because S.I. did nothing but offer and deliver on a great offer.

EA though, I'd love to see someone stick it to them for once with this whole thing about paying extra for live access on used games.

Nothing's more annoying to me then to watch a couple of bored idiots crying THIS MUCH over a damn video game because they have nothing else to do with their damn lives. It makes it even worse that the two idiots are from California.

Yeah, even though I've never liked the 2K football games as much as Madden (2k1 was pretty nasty though), it would be nice to see the competition again. Madden has improved in small ways year to year, but it's never a giant leap forward in terms of all the features. At least if it had some competition then it might be inclined to include more features every year than to rest on it's laurels and hold some of them back for the following year.

This, its SOOOO EASY for EA and the Madden developers to do it actually almost makes me mad/frustrated. Head Coach had everything perfected in terms of scouting players to fit schemes/testing them. Bring Head Coach's scouting system into Madden and all of a sudden the draft has meaning other than "who has 95 speed". Then add in a consistency rating to make players perform as they do in real life.

I got this e-mail the other day. I don't plan on doing anything, so I suppose I'll end up a part of it. It'd require more effort to opt out then just sit in, in case hell freezes over and something comes of it.

I got the email and just deleted it. A couple things I found odd about this email, one I would like to know how they got our email addresses and second how do they assume we want to be a part of it and have to opt out of something we didn't agree to in the first place.

I don't understand trying to get consumers involved, they will play Football regardless what it is and who makes it. It's that simple.
