Rookie Perrish Cox Faces Life In Prison

just came across this article... sounds like it was actually a good idea passing on him late in the draft...

The Broncos are falling apart. Sexual assault charges should not be taken lightly... not sure exactly what he did, but I'm sure details will come out in the next few days

For perspective, the minimum sentence, if convicted, is two years in prison while the maximum is life in prison. The charge is for allegedly committing sexual assault on a helpless victim incapable of appraising her own condition. This could be defined, theoretically, as anyone beyond the point of legal intoxication, anyone under the influence of drugs, or anyone who is rendered disabled by physical force or condition, either temporary or permanent.

Apparently, the victim's behavior and physical state made it clear that she was incapable of consent, and Cox allegedly knew that she was incapable and took advantage. This may imply the use of date-rape drugs or knowingly intoxicating her to the point that she would be rendered lucid or unconscious.

This doesn't look good for Cox at all. Regardless of complicity on the part of the victim in reaching that state of helplessness, it is implied by all counts that Cox did, indeed, sleep with her and the circumstances make it appear that he knew full well that she could not consent.

It's cases like this that justify the Ravens' personnel staff's stance on character issues. Cox had two prior (known) red flags for driving with a suspended license and violating team curfew rules in college. There is a pattern of behavior there that indicates irresponsibility, and I'm glad the Ravens caught it.

good post Franny... thanks for clearing it up (especially the life sentence being the maximum offense)

The last few comments you made are spot on... Many of us on this forum (including me) couldn't fathom passing on two elite talents so late in the draft in Cox and Mike Williams of TB, and both have played very well this year as rookies, but both have been arrested already in their first year in the league... It's frustrating still hearing all the "Baltimore players are a bunch of thugs" comments when character is a word that truly defines this team IMO

Hopefully the David Reed incident was a fluke and passes over time... I'd hate seeing a player mess up and ruin the reputation this organization is building

The Broncos and the NFL certainly don't need this. Hopefully, the victim can emotionally recover from the incident in time.

Like Franny said, the Ravens knew what they were doing by passing on him and so did most of the league.

There aren't many details being made available about the David Reed incident, but I don't believe he's guilty of anything big. Might be prescription drugs or something relatively minor, but nothing in the way of drug trafficking or any other worst-case conclusion that most people would jump to. Reed's demeanor and attitude throughout all of this indicate that he probably isn't guilty, as he has been upbeat and has not been flippant with the media when asked about the search and seizure at his house. I don't read this as arrogance or confidence that he'll get off easy, I read this as Reed knowing that he didn't do anything wrong. For now, I'll believe he's innocent until proven guilty.

As for Perrish Cox, it's hard for me to take his side or envision a scenario where he looks good at the end of this entire ordeal.

As an addendum, it is my understanding that the gravity of the charges hinge on the "helpless victim" classification.

Though sexual assault implies the absence of consent, victims in sexual assault cases are generally thought to have a means of properly indicating consent [i]or[/i] having a means of physical defense even if the assault is still carried out. In being helpless in this case, the victim was unable to make a determination of their consent because they were not of sound mind or body, likely due to an excess level of intoxication or impairment from a drug, among other possible scenarios.

The wording is extremely specific and necessary in order to indicate that it was also likely clear to the attacker that proper consent in the victim's state of being was not possible, and that the attacker carried out the crime regardless. This makes the charges much more grave than rape or any other assault, as the victim had no possible method of retaliation or prevention prior to and during the act.

Cox was the one bright spot during his whole tenure. Cox was a 5th round pick that played like a 1st round pick. Now even he might be gone. What a disaster McDaniels was.

From what Franchise has spoken, it seems to me that this man did, and does, have some questionable facets of himself, and should this be proven true in court, he's facing a life of trouble - especially if this should be the worst case scenario in regard to a prison term.
